| 摘要 |
同性婚姻 (same-sex marriage)，簡稱「同婚」，指的是同性之間的婚姻，同性戀婚姻 (gay marriage) 則是指同性戀之間的婚姻。兩者並不相同，但是兩者經常混為一談，本文第一部份說明了：無論贊成或反對同性婚姻，往往探討的都是同性戀的道德是非、或者同性戀歧視與平權，其實都與同性婚姻無必然關係。換句話說，同婚派與反同婚的婚家派爭議雙方現在各自的主要論證其實都是不甚相干的。不過本文也解釋了為何雙方都以不甚相干的論證交鋒。更進一步說，同婚派與婚家派爭執的是「只有異性之間可以結婚」，而不是「異性之間可以結婚」，也就是婚姻本身並非爭論焦點。本文則認為同性婚姻的爭議不應是聚焦於同性戀，而應是對於（異性）婚姻的探究，其功能目的與演變，但是不能普世化而是追尋其歷史社會的軌跡，至少首先從中國現代婚姻與台灣之演變來觀察。本文的第二部份則試論或提示作者認為討論婚姻時的兩個重要論點。首先說明同婚派與反同婚派都必需訴求婚姻的長遠傳統與「神聖性」，無法僅僅依賴現代婚姻的新趨勢潮流。其次，個人主義化是影響當代婚姻演變的重要趨勢，但是有其限度。 |
| Abstract |
The first part of this article explores the implication and consequence of the thesis that same-sex marriage is not the same as gay marriage. The second part discusses the importance of marriage tradition to the cause of same-sex marriage, and the limitation of modern individualization that has brought transformation to the traditional and conventional marriage. |
