| 摘要 |
人類身為具有智力的生命，不只是役使萬物為己用，而且是合理的使用自然的資源，不去過度的破壞，來平衡自然和人類生活的空間。為了相互在這星球都能存活下去，彼此要有適度的尊重。以下欲思考的研究問題是：動物權在憲法的位階，應該解釋為基本權利或是基本國策的範圍？希望以憲法解釋把動物權的憲法位階釐清，使得動物權在一般法律和憲法的層面，都有保障的明確依據，以法律實現動物保護的重要道德目的。簡言之，憲法基本權在本文的人民概念，因應臺灣現代社會的型態，可理解為人類及境內治理疆界的子民，動物在國家的治理疆界內，也會是被治理的子民之一，這就涵蓋了人類及國內的其他生命，都是憲法基本權保障的主體。 |
| Abstract |
As intelligent beings, human beings not only utilize various resources for their own benefit without excessive destruction but also manage natural resources responsibly to maintain harmony between nature and human life. For all beings to coexist on this planet, we must show appropriate respect for one another. This research explores whether animal rights should be regarded as basic rights or as part of national policy within the constitution. This study aims to clarify the constitutional hierarchy of animal rights through constitutional interpretation, ensuring that animal rights have a well-defined legal foundation within both general law and the constitution. Thus, the moral imperative of animal protection can be effectively realized through legal measures. In this article, the concept of 'the people' in basic constitutional rights includes both humans and other beings within the governance framework of modern Taiwanese society (or of Taiwan). Animals will also be recognized as subjects under the country's governance. This framework encompasses both humans and other living beings within the country, all of whom are entitled to constitutional protection of basic rights. |
