摘要 |
人在全球許多地區,動物保護是一種潮流,其中知名的倡議者Tom Regan以動物權利為其建構理論之進路,主張動物只要符合生命主體判準,便具有固有價值而擁有權利,且應該得到人類適當的對待。
本文將先闡述Regan動物權學說的基礎,接著針對權利部分進行探討,從界定道德權利與法律權利之差異,權利主張的有效性,權利義務的關係到動物權利的證成;最後,對Regan權利學說提出一些反對的觀點。 |
Abstract |
Animal protection is popular in the world. Tom Regan, a well-known advocate, takes animal rights as his approach of theory. He claims that animals have inherent value and rights as long as they conform to the-subject-of-a-life criterion, and should be treated appropriately by human beings.
This article will explain the foundation of animal rights theory, and discuss the rights as follow: the distinction between moral rights and legal rights, the relation of rights and obligations, the justification of animal rights. Finally, some opposite point of view which are against Regan’s theory. |
